FACTS:
The Defendant was driving
at a high rate of speed when law enforcement began their
pursuit with lights and sirens. The Defendant did not
immediately pull over but eventually pulled over after
approximately one mile. Law enforcement alleged that the
Defendant’s eyes were bloodshot, watery and glassy. They
further indicated that the Defendant failed the
Breathalyzer test and regurgitated several times prior
to the 20 minute observation period before administering
the Breathalyzer. Law enforcement claimed that the
Defendant performed poorly on the field sobriety test,
indicating that he lost his balance on more than one
occasion. Finally, law enforcement claimed that the
Defendant was mumbling during the course of the
investigation.
RESULT:
DUI reduced to reckless driving charge.
